<br><br>
Tipped employees must be paid these minimums with no reductions in pay by the employer for tips employees receive from customers.
<br><br>
A bill that, if passed, would raise Nevada's minimum wage, at the rate of 75 cents per year, to $12 per hour for employees with health insurance and $11 for those without, and was part of Nevada Democrats' 2018 campaign promises, is pending in the state legislature.
<br><br>
Most Nevada employees must be paid overtime at 1.5 times their base rate for hours worked over 40 hours in a week or 8 hours in a day, but exceptions apply to certain occupations. Working on a holiday does not require overtime pay.

If successful, the measure would then go on the ballot for voter approval in 2020. The new system would be similar to the one already in effect in California.

<blockquote>When Catherine Cortez Masto became the first Latina elected to the United States Senate, some of Nevada’s political class called her “the senator from Clark County.” Her victory map from November 2016 looked like a cupful of water at the tip of an upturned gas can. Clark was the only county Cortez Masto won. It’s home to the Las Vegas Valley, 2.2 million people, and 70 percent of the state’s electorate. By running up the score in Clark, she did enough to overcome losses in rural counties and a narrow defeat in Washoe County, which encompasses Reno. ...<br><br>
Libertarians, voters concerned about gun rights and federal land use, evangelical Christians, Mormons, and the business community are [Heller's] bedrock support. ...<br><br>
[Rosen] may need “The [former Nevada Senator Harry] Reid Machine,” the coalition of union members, their families, and former campaign aides to Harry Reid who are actively canvassing in Reno and Las Vegas, to outdo itself. ...<br><br>
The race may come down to the margin in “The Biggest Little City in the World”—Reno and its suburbs. Cortez Masto lost Washoe County, but by falling within 2 percentage points there, she kept intact the statewide lead she built in Clark County. This might explain why Heller has spent significant money claiming Rosen is in thrall to the ultimate Washoe County and Interior West boogeyman: California.<br><br>
“That plays to the libertarian strand in Nevada,” says David Fott, a political scientist at the University of Nevada, Las Vegas. “It’s the fact that California is overwhelmingly Democratic, hostile to libertarianism, with high taxes, high cost of living, what some people have left California to escape.”</blockquote>

<blockquote>[P]eople in expensive, high-tax coastal markets including San Francisco, New York, Los Angeles and Washington, D.C. searched for homes in metros like Phoenix, Las Vegas and Miami, where taxes are lower and housing is more affordable ....
<br><br>
Las Vegas, another low-tax haven, had the highest share of non-local searches. Forty-one percent of the people searching for homes in Las Vegas were searching from outside the metro area. Nearly 40 percent of these inbound searches originated in Los Angeles, followed by the San Francisco Bay Area (12%), Portland, Oregon (8%), and Seattle (5%). The influx of new residents to the area is causing prices and competition to accelerate. Median home prices in Las Vegas rose by 11 percent in July year over year, marking 17 months in a row of double-digit price growth.
<br><br>
“Affordability definitely plays a role in home searchers considering Las Vegas as their new home city,” said Nicole Lazarski, a Redfin agent in Las Vegas. “Even though home prices are climbing fast, they have still not returned to their 2007 height. With a median sale price around $270,000 in July, plus Nevada’s low property taxes and lack of a state income tax, it’s a very attractive place for people looking to leave California and other expensive places.”
<br><br>
In Las Vegas, the typical homeowner pays $1,500 (0.8%) in property taxes and about 8 percent in local sales taxes, with no state income tax, whereas in Los Angeles, the respective amounts are $3,600 (0.8%) property taxes, about 9 percent sales tax rate, and 8 percent state income tax rate. </blockquote>

These online sellers will need to register for a Nevada sales tax account and file Nevada sales tax returns. The thresholds ensure that eBay and Amazon marketplace sellers and other small online merchants will not be affected. The law comes in the wake of the U.S. Supreme Court's Wayfair decision, that paved the way for states to require sales tax collection by out of state retailers.

Lewis, No. 16-285; Ernst & Young LLP et al. v. Morris et al., No. 16-300; and National Labor Relations Board v. Murphy Oil USA, Inc., et al., No. 16-307 (May 21, 2018), the Supreme Court has resolved a conflict amongst the U.S. Federal Circuit Courts, and once again the Ninth Circuit has been overruled. This time SCOTUS confirmed that class action waivers in employee arbitration agreements are enforceable (if properly drafted). The Supreme Court had previously ruled these as enforceable in consumer arbitration agreements in 2011. The favorable ruling for employers had been opposed by the Obama Administration and more recently supported by the Trump Administration.
<br><br>
This ruling is a valuable tool for Nevada employers if properly deployed.

New York's LLC laws differ from Nevada's, but the key takeaways may be the same for Nevadans considering entering into a partnership based on an online, cookie-cutter document:<blockquote>[When] the members’ relationship turned bitter .... shortcomings in the operating agreement also contributed significantly to the parties’ legal postures and willingness to risk litigation....
I’m not suggesting that every lawyer-drafted LLC agreement is a model of perfection, but I found ... that a standard form operating agreement being sold online by a major company to the unknowing public as a more affordable alternative to using a lawyer ... suffer[ed] from such a fundamental flaw that, in the end, only intensified the parties’ legal conflict.</blockquote><a href="http://www.nybusinessdivorce.com/2015/06/articles/llcs/legalzoom-llc-agreement-bargain-or-blunder/" target="new">LegalZoom LLC Agreement: Bargain or Blunder?</a>Jonas M. Nevada limited liability companies will remain at $200 per year. Both fees were slated to decrease to $100 per year until the recent lawmaking. Additionally, annual list fees for most corporations and LLCs will also increase from $125 to $150 per year.<p>
The tax package that was enacted to balance the state budget also makes "temporary" increases in the sale tax and payroll taxes permanent.<p>
Nevada does not have a state-level corporate tax.<p>
For new incorporations, it may be possible to avoid the increased fee by selecting an LLC instead (when appropriate). For existing Nevada corporations, there are some other alternatives to consider, the complexity of which will vary depending on the client's circumstances - please contact me to discuss these.

The process by which an estate plan is implemented is, of course, called estate planning.

In a news interview, he explains that he found the form lease on a realtors’ website, and did not realize that the security deposit provisions in the form contradicted current security deposit laws in North Carolina.<br><br>
Other landlords can learn from the mistake. When using online rental forms, be sure to choose forms from a source that has both state-specific and up-to-date forms. One problem with using forms from websites is the difficulty in determining whether the law has changed since the form was posted.
<br><br>
It’s always a good idea to run the online form past an attorney before using it for the first time. That way, you catch any mistakes early on, before mass-producing the problem for every tenant.
<br><br>
The Attorney General says he will be seeking a $5,000 penalty against the landlord for each security deposit violation.</blockquote>Jonas M. According to <a href="http://www.forbes.com/sites/deborahljacobs/2012/08/10/adam-yauchs-will-reveals-his-private-dilemma/" target="new">Forbes</a>, Beastie Boy Adam Yauch, who died in 2012, and his wife, struggled with the issue and reached what appears to have been a compromise solution. Because Yauch and his wife used a trust in their estate planning, most of the rest of the details of their estate plan remain private.
<br><br>
"A guardian’s responsibilities range from the mundane to the monumental: everything from tying shoelaces and drying tears to selecting schools and medical care. Like Yauch, you should designate more than one person, so if your top choice is not available, your second preference is clear.
<br><br>
While you’re at it, you’ll probably want a testamentary trust (one created by your will at your death) to hold any assets you’re leaving minor children. In some states, if you have not made arrangements for both functions, the court will appoint a separate person to deal with the child’s money."

Some of these solicitations offer legitimate, albeit possibly unwanted, duplicitative, and confusing commercial offerings, while others seek to profit by deception. The safest course of action for trademark applicants and owners is to refer any communications to your trademark attorney.
The text of the <a href="http://www.uspto.gov/trademarks/solicitation_warnings.jsp" target="new">warning</a>, which is being provided by the USPTO to all new registrants:<blockquote> WARNING: Non-USPTO Solicitations That May Resemble Official USPTO Communications<br><br>
Be aware that private companies not associated with the United States Patent and Trademark Office (USPTO) often use trademark application and registration information from the USPTO’s databases to mail or e-mail trademark-related solicitations. Trademark applicants and registrants continue to submit a significant number of inquiries and complaints to the USPTO about such solicitations, which may include offers: (1) for legal services; (2) for trademark monitoring services; (3) to record trademarks with U.S. Customs and Border Protection; and (4) to “register” trademarks in the company’s own private registry.
<br><br>
These companies may use names that resemble the USPTO name, including, for example, the terms "United States" or “U.S.” Increasingly, some of the more unscrupulous companies attempt to make their solicitations mimic the look of official government documents rather than the look of a typical commercial or legal solicitation by emphasizing official government data like the USPTO application serial number, the registration number, the International Class(es), filing dates, and other information that is publicly available from USPTO records. Many refer to other government agencies and sections of the U.S. Code. Most require “fees” to be paid.
<br><br>
Some applicants and registrants have reported paying fees to these private companies, mistakenly thinking that they were paying required fees to the USPTO. So, be sure to read trademark-related communications carefully before making a decision about whether to respond. All official correspondence will be from the “United States Patent and Trademark Office” in Alexandria, VA, and if by e-mail, specifically from the domain “@uspto.gov.”
<br><br>If you receive a trademark-related solicitation that you believe is deceptive, you may file an on-line consumer complaint with the Federal Trade Commission (“FTC”), at www.FTC.gov. Although the FTC does not resolve individual consumer complaints, it may institute, as the nation’s consumer protection agency, investigations and prosecutions based on widespread complaints about particular companies or business practices.
<br><br>
The USPTO encourages recipients of misleading communications to contact the USPTO about them by emailing TMFeedback@uspto.gov. When notifying us about a misleading communication, please also:
<br><br>
Include a copy of the misleading communication (including the envelope it came in) if available;
<br> Indicate whether the recipient thought the communication was an official U.S. government communication or had to ask an attorney or the USPTO whether it was legitimate;
<br>Indicate whether fees were mistakenly paid in response to the communication and, if so, provide a copy of the cancelled check. Please also specify what services, if any, were provided in exchange for the payment made.

This document is an example of a private company solicitation about which we have received numerous recent complaints. We contacted the company (which was doing business under the name “United States Trademark Registration Office”) and have received assurance that this company has, as of March 12, 2012, ceased sending solicitations under that name. If you have received a solicitation from this company after March 12, 2012, please let us know at the above-listed email address</blockquote>Jonas M. So, lawmakers in several states—including Nebraska and Oklahoma—have tried in recent years to tackle the complex question of who can manage the online presence of the deceased, and what legal authority they should have. ....<br /><br />But legal experts say that the terms of service users must agree to when they sign up with social-media sites, which typically dictate what happens to an account after the user dies, could take precedent over the state laws. An Oklahoma lawmaker involved in legislation on the topic says the risk is creating laws that are "toothless."<br /><br />Facebook, for example, has extensive user agreements and privacy policies that cite various state and federal laws, including the federal Electronic Communications Privacy Act, which generally forbids it from "providing access to any person who is not an account owner." ....</blockquote><a href="http://online.wsj.com/article_email/SB10001424052970203315804577205122381359482-lMyQjAxMTAyMDEwMTExNDEyWj.html?mod=wsj_share_email" target="new">Deaths Pose Test for Facebook</a> by Steve Eder, Wall Street Journal, February 11, 2012Jonas M.
